Terms of Service — Vara

1. Acceptance of Terms

By downloading, accessing, or using Vara (“the App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.

2. Description of the Service

Vara is a wellness and nervous system tracking application. It utilizes your iOS device’s camera to measure optical heart rate data, calculates physiological metrics, and provides guided breathing practices.

3. Medical Disclaimer (Not Medical Advice)

VARA IS NOT A MEDICAL DEVICE. The App, including all measurements, scores, and guided protocols, is provided for informational and wellness purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Do not use the App as a substitute for professional medical advice, diagnosis, or treatment. Always consult a physician or qualified health provider regarding any medical condition or prior to starting any new breathing or wellness regimen.

4. Accounts and Access

To use the App, you must authenticate using Apple Sign-In. You are responsible for maintaining the security of your device and Apple account credentials.

5. Data Storage

Free Tier: Your wellness data is stored locally on your device. You are responsible for any data loss resulting from device failure or uninstallation of the App.
Premium Tier: Paid subscribers receive cloud backup functionality via Firebase.

6. Subscriptions and Billing

The App offers a premium subscription that unlocks cloud storage and advanced features.

Payment will be charged to your Apple ID at confirmation of purchase.
The subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
You can manage subscriptions and turn off auto-renewal in your Apple Account Settings.
Unused portions of the subscription period are not refundable.

7. Prohibited Uses

You agree not to:

Use the App unlawfully or abusively.
Reverse-engineer, decompile, or copy the App’s source code or proprietary measurement algorithms.
Bypass feature limits, paywalls, or subscription checks.

8. Intellectual Property

All App content, design, algorithms, trademarks, and source code belong to Vara (by Nicolas S.), excluding your personal wellness data.

9. Disclaimer of Warranties

The App is provided “as is” without warranties of any kind. We do not guarantee uninterrupted service, flawless biometric readings, or that your data will never be subject to accidental loss.

10. Limitation of Liability

To the maximum extent permitted by law, Vara (by Nicolas S.) shall not be liable for any indirect, incidental, or consequential damages, personal injury, or health issues arising from your use of (or inability to use) the App and its breathing protocols.

11. Governing Law

These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles.

12. Updates to These Terms

We may update these Terms as we add new features or adjust our policies. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
